Welcome to Gogogammon (the "App"), a backgammon game. These Terms of Service ("Terms") govern your access to and use of the App on iOS and any related services, including our freemium features and the subscription service Gogogammon Plus. By downloading, installing, or using the App, you agree to these Terms. If you don't agree, please do not use the App.

1. License Grant

We grant you a limited, non-exclusive, non-transferable license to use the App for your personal, non-commercial use, subject to these Terms and Apple's App Store terms. All rights not expressly granted are reserved.

2. Account & Eligibility

  • You must be at least 13 years old (or older if required by local law) to use the App.
  • You are responsible for keeping your account credentials secure.

3. Freemium Features & Gogogammon Plus

  • Freemium: Core game features are free.
  • Gogogammon Plus: Offers premium features via an auto-renewing subscription.

3.1 Subscription Terms

  • Billing: Payment is charged to your Apple ID account at confirmation of purchase.
  • Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
  • Cancellation: You can manage and cancel your subscription in your iOS Account Settings. No refunds for unused portions.

4. Changes to These Terms

We may update these Terms from time to time. When we do, we will notify you by:

  • Posting the updated Terms in the App, with a new "Last updated" date; and/or
  • Sending an email to the address associated with your account.

Your continued use of the App after changes take effect constitutes your acceptance of the new Terms.

5. Disclaimers & No Warranty

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, OR NON-INFRINGEMENT.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WE, OUR AFFILIATES, OR OUR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR DIRECT DAMAGES WILL NOT EXCEED THE AMOUNTS PAID BY YOU TO US IN THE SIX (6) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY.

7. Intellectual Property

All content, trademarks, and other intellectual property rights in the App are owned by us or our licensors. You agree not to copy, modify, distribute, or create derivative works without our express permission.

8. Termination

We may suspend or terminate your access if you breach these Terms or engage in fraudulent or harmful conduct. Upon termination, all rights granted to you will cease immediately.
